Chameleon Inflatables is a manufacturer and seller of inflatable products. We do not operate rental or hire services. Once a product has been sold and delivered or collected, it becomes the property of the buyer, and all subsequent use of the product is under the sole control and responsibility of the buyer or operator.

Transfer of Responsibility

Once a product has been delivered or collected, the buyer assumes full responsibility for:

•Supervising all users, particularly children

•Ensuring the product is used only for its intended purpose

•Complying with the safety guidelines provided with each product

•Assessing weather conditions and suitability of the setup location

•Maintaining the product in safe working condition

•Training any staff or operators who will manage the product

Chameleon Inflatables' Position

Chameleon Inflatables has no control over how, where, when, or by whom our products are used after sale. Accordingly, we cannot and do not accept liability for:

•Injuries, accidents, or damages caused by misuse of the product

•Failure to follow our provided safety guidelines or user manuals

•Inadequate supervision of users

•Use in inappropriate weather conditions (strong wind, rain, lightning)

•Setup on unsuitable surfaces or without proper anchoring

•Use beyond the product's stated capacity, weight limits, or age ranges

•Modifications made to the product after sale

•Use by intoxicated persons or persons with medical conditions that make inflatable use unsafe

•Third-party acts, including vandalism, theft, or interference

•Power failures, generator issues, or blower failures not caused by our manufacturing

5. Manufacturing Defects (Our Responsibility)

Consistent with our obligations under the Consumer Protection Act, Chameleon Inflatables accepts responsibility for:

•Defects in workmanship or materials present at the time of supply

•Failure of the product to meet the general specifications described at the time of sale

•Reasonable warnings and safety information provided with each product

Where a manufacturing defect causes harm, our liability will be assessed in accordance with the Consumer Protection Act and our Warranty Policy.

6. Warranty Disclaimer

Our products are covered by the warranty outlined in our Warranty Policy. Except as expressly stated in that policy, we make no additional warranties, express or implied, regarding:

•Merchantability beyond the specific use cases described

•Fitness for any particular purpose not explicitly agreed in writing

•The product's suitability for commercial hire operations (unless specifically discussed at time of sale)

Some components used in our products (such as blowers, motors, and pumps) are manufactured by third parties and supplied with their own manufacturer's warranty. Chameleon Inflatables is not the manufacturer of these components and cannot be held liable for defects in third-party parts. •Any liability that cannot be excluded under applicable South African law

10. Customer Responsibilities Checklist

Before using any Chameleon Inflatables product, customers must:

•Read and understand the safety guidelines supplied with the product

•Inspect the product for any visible damage before each use

•Ensure the setup location is flat, clean, and free of sharp objects

•Use proper anchoring (stakes, sandbags) as appropriate for the setup

•Ensure suitable weather conditions — do not use in winds above 25 km/h or in rain (matches the warranty wind-speed limit in the Warranty Policy)

•Supervise all users at all times, particularly children

•Observe stated capacity, weight, and age limits

•Keep the blower running continuously during use

•Never allow use while under the influence of alcohol or drugs

11. Professional or Commercial Use

Customers who intend to use our products for commercial purposes (event hire, rental businesses, schools, day cares, entertainment venues) are responsible for:

•Complying with all applicable South African health, safety, and business regulations

•Obtaining any necessary permits or approvals

•Training their staff in safe setup and operation

•Maintaining appropriate business records and risk assessments

Chameleon Inflatables accepts no liability for commercial use conducted without compliance with applicable regulations.
